I applied 485 on July2nd 2007, we never got the FP notice, I called up the USCIS inquiry number, opened two service requests, nothing happened. My lawyer sent a letter asking USCIS to look at our case, that was ignored as well. We finally got an Infopass appointment and went to the office today, after a little bit of confusion, we were told that the most likely cause was that we sent pictures along with our EAD applications and that confused CIS procedures and they missed sending us FP notices.
Cant believe this crappy explanation, but this is what we were told. We were told that usually they call people in for FP and take the pictures and then process the EADs. Anyway, it took all of ten minutes to figure this out and issue us an FP notice, there is no reason they couldnt have done this over the phone...
Good thing though is that not having the FP done does not stop then from processing the Name check and infact my wife's name check has been completed..

I personally think GC quota has a rationale behind it. It allows for a reasonable share to go to smaller countries so that the US population maintains its diversity. Besides, near the end of the year, if the numbers are unused, they are rolled over to larger countries like India and China, thereby automatically eliminating the quota.
If the original intend was to promote diversity (whether it is in FB or EB immigration), quota should be based on ethnicity of US population ( GC holders and citizens ). Ceiling should be applicable to countries those have a high percentage of representation in US population. Does India or China constitute a majority in US population ? No way. Indians and Chinese are a minority in US population.

So if the kid gets his GC and you do too because he, like many other kids, are removed from the queue, is that a problem or a good thing?
Plus in a lot of fields, having an MS or PhD is absolutely necessary.

If I simplify the whole attitude of IV members; it would be "EB3 is hopeless; EB2 doesn't need any help".
The way the whole EB GC stands now, EB2 folks do not need any additional help. The dates are moving relatively fast. In a year or two most of the EB2 folks will get GC. So why spend money and time in IV efforts?
As far as EB3 folks are considered, we have no hope. CIR is dead; piecemeal efforts are opposed by CHC. IV has never shown much interest in piecemeal efforts, despite the fact that what ever little efforts have resulted in enormous positive results.

Let me ask you this:
-If you didn't choose to study medical or IT and never came to US, would you be thinking the same (problems in India and reasons not to settle in India etc) as you are thinking today?
-If US government didn't have the provision of employment based GC, would you be thinking the same as you are thinking today(problems in India and reasons not to settle in India etc) ?
The answer of the questions above is either YES or NO. I'm sure that many of us will answer these questions as NO.
And if the answer is NO and and you are still counting problems in India and trying to justify your stay in US, then I'm afraid my friends you guys are being opportunistic.
No matter how bad it is, that country made you capable of using this forum. You shouldn't backbite and find problems and issues in that country. You should rather use your energy in solving problems in India. Don't say it is not possible. Nothing is impossible.

Labor Substition was a devil which has created most of this problem as I can see there are hardly 15-20% original beneficiaries for these 2002-2003 Labors.
Employers made Labor Sub a Devil by misusing it. It has been provided to employers as a valid advantage from employer perspective.
Infact GC has become a retention perk for the employer and from the employer perspective all they need is unlimited H-1B permits. All this added to the fuel that GC has become a perk to the employee because they suck up 6 years of H-1B servitude and not a Employer benefit anymore.
I think the Govt and USCIS start to think now that
H-1B is employer benefit
GC is employee benefit
and they are slowly moving to make changes in the current law.

Isn't that they have completed input and receipt issuance for cases received by certain date (late Aug.?) according to their update? How come so many July filers still have not received receipts? Weird!
No, it seems as per the latest USCIS update (on Sept 7, 2007) the NSC has completed issuing receipt notices till July 28, 2007, and TSC till July 2, 2007.
Do you have any other updates?

For your Information India's GDP is 3 trillion USD compare to Mexico 1 trillion USD. Taking into account GDP of EU India ranks 5th in GDP higher than any indivisual European nation where as Mexico ranks 13th. This is as per CIA worldfactbook. So where did you get the number

Without the PPT adjustment, India's GDP is equal to Mexico's, even though India has 11 times the population of Mexico. The reason India comes in 4th with the PPP adjustment in the world is because the ruppee is undervalued and Indians have a purchasing power that is 4 times smaller than Mexicans. So, to humor you and use your method of calculation, the Per Capita GDP (PPP) Of India is $3,344 in 2006 and Mexico's is $12,886. "Where are all the Mexican doctores, computer scientists, economists and professors?" you ask. The answer is: They are IN MEXICO making huge salaries, when the Indian ones have to come here because their salaries in India don't give them enough money to eat. Why aren't all the construction workers and lawn workers in the U.S. Indian? Because they cannot affor the airfare. The Mexicans just walk accross the border. Any you know what? All those Indian Professors at Harvard etc are teaching class to all those rich Mexican kids. Get your facts straight before you confront me and make fun of my MBA (which I got in the U.S. incidentally, not Mexico, but if I had wanted I could have gotten a top 20 MBA back home). I guess it would have to be a pretty big and wild rally to have the police getting involved. :p
But Chandu raises an excellent point. There is much more to a rally than just turning up. Some one from core can probably help with detailed instructions.. these are just my thoughts.. feel free to add/correct.. (PS: I have zero experience in rallies, by the way)
First, I suppose checking with the local authorities and informing them of your plans, expected turnout, location, duration etc before anything else is a good idea. Bad idea to have have an unexpected crowd turn up randomly in a public place.
Organize placards, banners, podium, hand outs etc. Dont forget first aid kits, water.
Figure out who is going to be the spokesperson for the rally. Would be pretty silly if a reporter does come there and no one knows how to articulate well.
The spokesperson should check with core regarding message etc. This is important.
If there is critical mass for the rally, and the authorities are informed etc, then contact the local news and inform them as well..
Any other ideas/tips?

In case of unanticipated actions - we may never know if politically we will have any help fro higher ups.
Also - please check the numbers ( remember though a lot of people show enthusiasm in discussion forums, in reality you will find very less people taking part)
So please do your homework and do a lot of discussion. Do not hurry up and rush into rallies. A lot of rallies are done by disciplined leaders who plan these well in advance.

I understand the momentum here....not trying to rain on a parade or anything...but shouldnt we be a little practical. How long is litigation going to take? Wont only naive lawyers even take this up?
USCIS can always pull the security reason trump card here.
moreover, during the last quarter...in the effort to not waste visas, low hanging easy to approve cases with later priority dates have gotten approved. wudnt u rather have that than visas going waste?
We have been patient for a very long time....lets see how the dates move in the 1st 2 quarters of fiscal 09.
My personal suggestion....stop worrying aout GC...there are much bigger things in life to worry about. :)

You are wrong. There have been lot of changes. Two year EAD for one. And how about EB2 category moving to mid 2006 so most of the EB2 people before that have got GC or will surely get it next year. The only thing that hasn;'t changed is EB3 India. It was stuck in 2001 at that time and still is in 2001. It will crawl to 2002 in the coming year but that's that.

Come on, your comment "limbo for five years" without basis. The FB2 cat is not very far behind. Only 6 months - 1 year behind in most cases. check VB.

There is no legal basis for them to be in EB quota. period.
If you are USC and then you are talking abou the FB2. Not for the GC holder. So will have to wait for years.
Come on, your comment "limbo for five years" without basis. The FB2 cat is not very far behind. Only 6 months - 1 year behind in most cases. check VB.
Stop using words anti etc. I am just like you frustrated like hell.
My primary point is EB dependents must be out of EB quota.
There is no legal basis for them to be in EB quota. period.
If you are USC and then you are talking abou the FB2. Not for the GC holder. So will have to wait for years.

As we are nearing to August ending, does any one have a good idea of how many cases approved in this month. (Auguest 2010)
I see 384 cases approved for EB2 India in track it. i am expecting it is much more than that in August 2010. any comments.

Buddy, it looks like its only you and me remaining who has not received the FP notice. For me its been 30 days since opening SR and nothing. We are the unfortunate ones who have not only not received FP but our application are in TSC , where opening an SR is of no use.
I am July 2 filer (@TSC), still waiting for FP notice. Got I-485 receipt (ND Aug 27), and approved EAD and AP. Did not call for SR yet.
